Sody App Copyright Policy

1. Introduction

Sody App Pte. Ltd. ("Sody," "we," "us," or "our") respects the intellectual property rights of others and expects users of our platform ("Platform") to do the same. This Copyright Policy outlines our procedures for addressing claims of copyright infringement on the Platform.

Terms not defined in this Copyright Policy (such as "User Content," "Salon," or "Platform") shall have the meanings set forth in our Terms of Service.

This includes claims relating to salon listings, package descriptions, stamp or reward artwork, photos, videos, and other User Content uploaded or displayed through the Platform.

It also includes claims relating to localized or translated text, translated marketing copy, translated chat excerpts, credit descriptions, and other language-specific variations of content displayed through the Platform.

This policy is designed to comply with the requirements of the Singapore Copyright Act 2021. Our procedure follows a "notice-and-takedown" model consistent with international best practices.

2. Reporting Copyright Infringement

If you are a copyright owner or an agent thereof and believe that any User Content on our Platform infringes upon your copyrights, you may submit a notification to our designated Copyright Agent. For your complaint to be valid under the Copyright Act 2021, you must provide the following information in writing (a "Takedown Notice"):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed. If multiple works are covered, a representative list is sufficient.
  3. Identification of the infringing material and information reasonably sufficient to permit us to locate it on our Platform (e.g., providing the full URL to the content).
  4. Your contact information, including your name, address, telephone number, and an email address.
  5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and that you are authorized to act on behalf of the copyright owner.

PLEASE NOTE: Please be aware that you may be liable for damages (including costs and attorneys' fees) if you knowingly make a material misrepresentation in your Takedown Notice. If you are unsure whether the material infringes your copyright, we recommend seeking legal advice before submitting a notice.

4. Counter-Notice Procedure

If you believe that your User Content was removed or disabled as a result of a mistake or misidentification, you may send a counter-notice ("Counter-Notice") to our Copyright Agent containing the following information:

  1. Your physical or electronic signature.
  2. Identification of the content that was removed and the location where it appeared before its removal.
  3. A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, telephone number, email address, and a statement that you consent to the jurisdiction of the courts in Singapore and will accept service of process from the person who provided the original Takedown Notice.

Upon receipt of a valid Counter-Notice, we will forward a copy to the original complaining party. If we do not receive notice within 10 business days that the original complainant is seeking a court order to prevent further infringement, we may replace or restore access to the removed content.

PLEASE NOTE: Submitting a false Counter-Notice may also result in legal liability.

5. Repeat Infringer Policy

In accordance with our policy and applicable law, Sody will, in appropriate circumstances, terminate the accounts of users who are determined to be repeat infringers of copyright.

We also reserve the right to terminate accounts for a single instance of infringement at our sole discretion, or for any other reason as outlined in our Terms of Service.

7. Modifications

Sody reserves the right to modify this Copyright Policy at any time. We will post any changes on the Platform and update the "Last Updated" date. Your continued use of the Platform after the posting of changes constitutes your acceptance of such changes.
